    Preambule

    The present TERMS & CONDITIONS are intended to govern the contractual relationship between RENAISSANCE LUXURY AUSTRALIA PTY LIMITED, its headquarters located at Suite 12, 1 Box Road, Taren Point NSW 2229 (hereinafter “Renaissance”) and any individual (hereinafter “Customer”,”, or "you ") who wishes to make a purchase via the www.lesgeorgettes.com website (hereinafter the “Website”).

    These Terms & Conditions of Sale will prevail over any other general or specific conditions not expressly approved by Renaissance.

    These Terms & Conditions may be modified at any time, Renaissance therefore advises you to read them regularly. The terms applicable are those enforced on the website on the date the Customer’s order is placed.

    These Terms and Conditions of Sale are applicable to any purchase placed on the website and are those that are in effect at the time the order was placed. When you select the "I accept" box or a similar box in the Order Confirmation section before completing your order on the Renaissance website, you are indicating your full acceptance of these Terms & Conditions. If you refuse to accept the Terms & Conditions, you will not be able to place an order for Les Georgettes by Altesse products on the Website.


    Article 1 : Products

    1.1 Descriptions and Photographs

    The products covered by these Terms & Conditions are those presented on the Website. Each product offered on the website is accompanied by one or more photographs, a descriptive text of the materials and colours ; this information is informational only and not a binding contract.

    The descriptions and photographs of the products sold on the Les Georgettes website are as accurate and faithful to reality as possible ; however, the colours, dimensions, textures and other product characteristics may be altered by the screens or web browsers used to view them.

    The Customer acknowledges that the photographs, descriptions or images accompanying and illustrating the products offered for sale on the Renaissance website are illustrative and non-binding and not the responsibility of the seller in case of error, omission or modification.


    1.2 Product Availability

    All orders placed through the Website are subject to availability and acceptance by Renaissance.

    Renaissance reserves the right to refuse at any moment in time any order of more than five copies of the same item.

    The product offers are valid as long as the products are visible on the site, within the limit of available stocks, and excluding promotional items.

    In the case of product unavailability, Renaissance will inform you by e-mail and/or by telephone and will offer to you an article of equivalent quality and value. If you choose to refuse this opportunity for a replacement offer, Renaissance will automatically cancel your order and you will be refunded within one month following your initial payment.


    Article 2 : Orders

    2.1 Order placement Protocole

    If you wish to place an order on the Website, you must create a personal account. When you have created your personal account on the Website, you are indicating your full acceptance of and consent to terms of our Privacy Policy set forth in Article 8 herein (including, without limitation, your consent to provision or transmission of your personal data to any of our group companies identified in 8.3 below). Your order will be processed as follows: Once you have selected a product, please click on the "Add to Shopping Cart " button to place this product into your shopping cart. You then can decide to continue your purchases and add them to your cart (subject to availability and quantity limits) and proceed to payment by clicking on the "Validate Cart" button. You may also remove one or more products you have placed in the Shopping Cart. Then, you verify that the delivery address is correct. If not, you can enter a new one. Once this is completed, the shipping costs are calculated.

    The website then will instruct you to read and accept the Terms & Conditions by selecting the corresponding box (typically the "I accept" box or a similar box in the Order Confirmation section), at which point you will be deemed to have accepted these Terms & Conditions, then invites you to validate your order by clicking the "Go to Payment" button. The Website then asks you to verify all of the information and to choose the preferred payment method "Payment by credit card or Paypal" (cf 3.2 Payment terms). The last step in order to complete your order is to click the "I validate my payment" button. Upon validation of your order, you will receive an email confirmation.

    Notwithstanding anything to the contrary provided for herein, Renaissance reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Renaissance may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order of if Renaissance suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Terms & Conditions or the policies incorporated herein by reference.

    2.2 Order confirmation

    In order to place an order, you commit to communicating to the Website only the information necessary for performance of the service discussed in the Terms & Conditions. In the event of payment failure, incorrect address or other problems on your account, Renaissance reserves the right to block your order until the problem is resolved.

    Orders will be valid only after the payment has been accepted.

    Notwithstanding anything to the contrary provided for herein, Renaissance reserves the right to refuse, cancel and terminate orders at any moment in time. For example, Renaissance may refuse, terminate or cancel your order if there is an ongoing dispute concerning payment of a prior order of if Renaissance suspects, in its sole discretion, that you have engaged in fraudulent or grey market activities or have otherwise violated these Terms & Conditions or the policies incorporated herein by reference.

    Renaissance also reserves the right to cancel all or part of an order in the event of a manufacturing defect, force majeure or exceptional circumstances. Renaissance will notify you as soon as it has apprised of the circumstances and it will proceed to reimburse the sum you have paid Renaissance in connection with the cancelled order, or the part of the order that was cancelled. Under all circumstances, Renaissance will contact you as soon as possible to discuss all of the possible options for reimbursement and exchange.


    2.3 Order Tracking

    Upon receipt of the email sent by Renaissance, you can track the order status by clicking on the buttons "MY ACCOUNT " and then "MY ORDERS."

    The Customer can also track the order via an automatic email update that is sent at each step of the order process.


    Article 3 : Prices, Terms of Payment and Delivery

    3.1 Prices

    The prices displayed on the Website are indicated in Australian Dollars including all Australian taxes and product packaging, with the exception of shipping rates.

    The prices include the Goods and Service Tax (GST) applicable at the date of the order; any change in the rate may be reflected in the price of the products.

    The shipping fees will be communicated at the time of the order, before the order is validated.

    Renaissance reserves the right to modify prices and delivery costs at any time without prior notice. The price of a product and delivery costs displayed on the Website, at the time Renaissance provides you with a Confirmation of Order, will be honored by Renaissance. A price cannot be changed after the order has been placed.

    Please note that changes to applicable law between the date your order is placed and the date you are sent a Confirmation of Order may result in changes to the sales tax associated with your purchase. If the resulting change is an increase in the sales tax you are charged, Renaissance will contact you and ask that your reconfirm your purchase.

    The products remain Renaissance’s property until payment of the entire sum of the order has been collected.


    3.2 Modes of Payment

    You can proceed with payment either:

    - by credit or debit card (Visa, MasterCard): the total amount of your order is charged/debited at that time. The date the order is registered in Renaissance’s system is the same date that payment was accepted.

    - by Paypal : the total amount of your order is debited at this time. The date the order is registered in Renaissance’s system is the same date that payment was accepted.

    Any order that was paid by credit or debit card is considered valid only when the payment centers have given their approval. In order to ensure the security of the payments, the data are encrypted and transmitted by the SSL protocol to the payment platform.


    3.2 Shipping & Delivery

    The products are delivered to the delivery address that the customer entered during the order process before the validation of the order was completed.

    Renaissance only accepts orders for delivery to addresses in Australia. Please note that Renaissance delivers only to residential addresses; we do not deliver to military or certain restricted areas, P.O. boxes, or hotels.

    If you order several products, and in the hypothesis of stock shortage, Renaissance may proceed to partial shipments.

    We will use commercially reasonable efforts to deliver the products, or to ensure the delivery by our third party shipping provider, on the estimated delivery date mentioned in your order.

    In the event of a shipping delay, you will receive a new delivery date by email.

    In the event of a delay of more than 7 days, you have the opportunity to cancel your order within 60 working days from the original date marked for delivery. If in the case you have received the package after the cancellation of your order, Renaissance will proceed to the refund the cost of the product and the cost of return shipping, upon receipt of the package, with all original components included. Renaissance will process the reimbursement as soon as possible, and at the latest, 15 days within receipt of the returned order.

    Upon receipt of your package, you are asked to verify that the packaging is not damaged, and, if damaged, Renaissance’s kindly asks you to refuse the package and notify it by email or telephone.


    Article 4 : Fraud

    Renaissance reserves the right to ask for proof of residence and proof of identity before the order is shipped in order to prevent fraud. In the absence of these documents or, if the documents are not sufficient to prove the identity or residential address of the Customer, Renaissance would be obliged to cancel the order. In order to protect Renaissance from fraudulent activity, Renaissance records the following data : date and time of transaction, IP address.

    By placing an order on the website, you declare and confirm that you are a bona fide customer and that you will not deliver, sell or distribute Renaissance products, nor will you purchase Renaissance products for any retail purpose.


    Article 5 : Order Cancellations and Returns

    5.1 Right to cancel the purchase agreement

    Items purchased from the Website (with the exception of personalised product orders including, but not limited to, engravings, welded letters, cur-out names) may be returned within 14 days from the date of their receipt by you. Products that have not been purchased on the Website may NOT be returned to Renaissance e-boutique distribution center.


    To take advantage of this return policy you must either:

    - return the items in their original condition by mailing them back to Renaissance Luxury Australia, 4E/6 Jubilee Avenue, Warriewood NSW 2102 within 14 days from the date of their receipt by you; or

    - notify Renaissance by email at [email protected] within 14 days from the date of their receipt by you. In this case, items must be sent promptly and in their original condition to Renaissance Luxury Australia, 4E/6 Jubilee Avenue, Warriewood NSW 2102 within 14 days of notifying Renaissance of your intent to return items.


    If you choose to take advantage of this Return policy, Renaissance will refund the full cost of your order within one month from the date the items have been received.

    You may also return goods in accordance with any rights you may have under the consumer guarantees in the Australian Consumer Law.


    5.2 Return Exclusions

    The following are excluded from any return :

    - Inappropriate or incorrect usage.

    -Damages due to incorrect handling, abusive or abnormal use, intentional or accidental physical modification and use for business or commercial purposes.

    -Deterioration as a result of an external events (including, without limitation, physical damage, water damage and natural catastrophes)

    -Maintenance carried out by any non-Renaissance designated sales service professional, as well as the deterioration resulting from such maintenance.

    All refunds will be made on the same payment method used for purchase.



    Article 6 : Warranty and Liability


    6.1 Warranty

    Renaissance’s products benefit from the legal guarantee in accordance with the Australian Consumer Law, as well as other applicable law The warranty does not cover : accidental losses and breakages; inappropriate or incorrect usage; damages caused by daily wear and tear; poor maintenance; maintenance carried out by any non-Renaissance designated sales service professional, as well as the deterioration resulting from such maintenance; Deterioration as a result of an external events (including, without limitation, physical damage, water damage and natural catastrophes); watch’s batteries or wristwatch;

    Any defective and non-conforming product purchased on the Website only can be returned to us with the detailed explanation for the defects or non-conformity you allege and Renaissance will review and inspect the returned product to verify the alleged defect or non-conformity. In the event Renaissance finds the product to be actually defective or non-conforming, Renaissance will offer you either a credit, an exchange or a refund.

    If Renaissance determines you are eligible to be reimbursed, the exact amount of the product or products purchased, along with the shipping costs will be refunded within one month from the date you notify us of your decision to return the item(s). The shipping costs related to the return of an item are the responsibility of the Customer. Any customs costs related to the return of a product from a foreign country are the responsibility of the Customer.

    6.2 Liability

    In the online sales process, Renaissance is bound solely by an obligation of means. Our liability cannot be incurred for damages resulting from the use of the Internet such as loss of or disruption of service, viruses or other unintentional problems. In particular, Renaissance shall not be liable for any damage caused by (I) your own actions, omission or fault ; (II) any case of Force Majeure ; (III) any third party not related to Renaissance for the execution of the contract (for example, in the event of problems arising from performance, heavy telecommunication traffic or the performance of your technology systems) ; or (IV) any other event that Renaissance or its suppliers could not have foreseen or prevented even if Renaissance or its suppliers had taken all necessary precautions.

    In particular, the following will be considered as your responsibility : any damage or fault that you suffer resulting from the inadequacy or incompatibility of your computer equipment (hardware and/or software) with all or part of the website and/or the failure to implement all reasonable and necessary safeguards against any potentially harmful programs, devices or communications, as it is your responsibility to (I) verify or have verified that your computer and/or telecommunications equipment is adapted and compatible with the website prior to use and (II) implement all reasonable and necessary protections against any other harmful programs, devices or communications, including anti-virus software.

    Renaissance declines any responsibility in the event that the merchandise delivered does not respect the legislation in the country of delivery, if this country is outside of the European Union.

    Renaissance cannot be held responsible in the case of variations or differences between the images, descriptions, texts and illustrations of the products on its website, and the products ordered.


    Article 7 : Intellectual Property

    All texts, photos, videos, data, display, logo, trademark and other material reproduced on the website are reserved and protected by intellectual property law, including copyright, ancillary rights, and by the legislation on data security.

    No use, dissemination or reproduction or other use of these elements, even partial use, may be made without the express authorisation of the author in accordance with articles L 111-1, L 122-1 and L 122-4 of the Intellectual Property Code and/or other applicable laws.

    Any breach of these provisions constitutes infringement and is therefore liable to prosecution, including penal sanctions.

    By sending, posting to or sharing with Renaissance any content (including your feedback to Renaissance’s products) on the website (“Your Content”), you grant Renaissance non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the service and to promote Renaissance, or our services and products in general, in any formats and through any channels, including our website or third-party website or advertising medium. You further covenant that you will not exercise any moral rights in or to Your Content.


    Article 8 : Intellectual Property

    Your personal data and information are necessary for the proper management of your order and for us to be able to carry out communications with you.

    This data may be transmitted to partner companies that contribute to the successful performance of services such as order processing, order management, and payment. This information and data are also kept for security purposes in order to comply with legal and regulatory requirements.

    8.1 Identity of the person responsible for data handling

    Personal data are collected by RENAISSANCE LUXURY AUSTRALIA PTY LIMITED.


    8.2 Collected Data

    The personal data collected on the Renaissance website are intended for use on the Renaissance website, with your consent, which you will be deemed to have given us upon creation of your personal account in accordance with 2.1 above. Renaissance is committed to protecting your personal data. All personal data concerning you that are collected by Renaissance are treated with the strictest confidentiality, in accordance with Privacy Act 1988 and the Australian Privacy Principles (APPs) as well as other applicable laws, for the purpose of processing orders.

    Renaissance collects and processes your contact information (such as name, postal address, email address, and mobile or other telephone number); username and password; payment information; purchase and transaction information; customer service information (such as customer service inquiries, comments and other content you provide); information regarding your personal or professional interest, date of birth, marital statutes, demographics, and experiences with our products and contact preferences; contact information you provide about friends or other people you would like us to contact; and information we may obtain from our third-party service providers.

    Mandatory information is indicated by an asterisk. Some data are automatically collected as a result of your actions on the website.

    Renaissance also conducts research on the audience of its website, such as the number of page views, the number of visits to the site as well as visitors’ activity on the site and frequency of their return.

    We may use the information described above to :

    - Provide products and services to you;

    - Process your payments;

    - Create and manage your accounts;

    - Send you promotional materials and other communications;

    If you wish to request Renaissance to notify you of purposes of use of, disclose or access, rectify, add or delete, suspend the use of, or suspend provision to third parties of your personal data or to complain to Renaissance in connection with your personal data,

    Please indicate your first and last name, mailing address, email address and your customer reference number. Your inquiry must be signed and accompanied by a photocopy of an official Identity Document bearing your signature. Please be precise as to the address to which the reply should be sent. A reply will be sent to you within 2 months of receipt of the request.



    8.5 Cookies

    Renaissance’s website is designed to meet your needs. This is one of the reasons Renaissance uses cookies in order to identify you and access your account, manage your shopping cart and site visits.

    The cookie is a record of information that Renaissance places on your computer: It is intended to simplify your navigation on Renaissance website. It cannot contain viruses. It stores items in your shopping cart allowing you to continue to browse and shop.

    You have the option to disable these cookies at any time; however, if your browser is set to deny access to cookies, you will not be able to make purchases.

    Some cookies are set by Google Analytics which we have chosen to use as supplier.


    Article 9 : Archiving-Proof

    Renaissance archives purchase orders and invoices on a reliable and durable database that maintains a true and correct copy of the documents.

    Renaissance’s computerised records are considered as proof of communications, orders, payments and transactions between parties.

    For contracts of a total of 120 euros or more including tax, Renaissance undertakes the responsibility to retain the contract for 10 years from the date of signature; this contract will remain at your disposition.


    Article 10 : Applicable Laws and Dispute

    The current terms and conditions are governed and interpreted in accordance with Australian law, regardless of the country the good(s) are to be delivered in.

    In the context of a dispute between the parties and following failure of a written complaint from the Customer to customer service (via the following address: Renaissance Luxury Australia, 4E/6 Jubilee Avenue, Warriewood NSW 2102) or in the absence of a response from this service within a period of two (2) months, the Customer has the option of using a conventional mediation procedure or other alternative dispute resolution procedure.

    You agree that any disputes or controversies arising out of or in connection with these General Conditions of Sale shall be subject to the exclusive jurisdiction of Sidney Court of Justice.


    Article 11 : Final Provisions

    11.1 Entire Agreement

    The Terms & Agreement constitute the entire agreement between you and Renaissance regarding your purchase of Renaissance products through the Website, and supersede any prior conditions of sale.


    11.2 Severability

    In the event that any provision of the Terms & Conditions shall be determined to be partially void or unenforceable by any court having jurisdiction and for any reason whatsoever, it shall be void or unenforceable to that extent only and no further and the validity and enforceability of any of the other provisions of the Terms & Conditions shall not be affected.
